Conducting Criminal Record Checks in Connecticut

Persons may not be disqualified from employment by the state or from any business licensed by the state solely because of a prior conviction of a crime. Records of arrest that are not followed by a conviction, or records of conviction that have been erased, cannot be used by the state in connection with an application for employment or licensing.

Effective October 1, 2003, a health care facility cannot discriminate or retaliate in any manner against an employee because the employee submitted a complaint or initiated or cooperated in an investigation by or proceeding before a governmental entity relating to the care or services by, or the condition in, the facility.

Permissible practices.--Employment may be denied because of a prior conviction of a crime if the following factors led to a determination of unsuitability: the nature of the crime and its relationship to the job applied for, the degree of the person's rehabilitation; and the time elapsed since the conviction or release.
